During a hearing on Wednesday, state attorneys expressed concerns about the alleged victim’s readiness to go to trial. They asked for the trial to be moved to September, with the option to delay the case into October, if needed.
Defense attorneys opposed the request, arguing that waiting for trial has disrupted Kingston’s life.
In his ruling, Judge Jay Winward was skeptical that the alleged victim would be ready for trial in September, having already granted previous continuances. Without any assurances that the trial would move forward in the fall, Winward denied the state’s request for a two-month continuance.
Prosecutors requested a status hearing to be scheduled next week; However, Judge Winward also denied that option.
“The state is not ready. The victim is unprepared to testify, and that’s ok,” said Judge Winward. “The case is dismissed without prejudice.”
